The agreement
These Terms of Service (the “Terms”) form a binding agreement between you (“you”) and CelpipTest (“CelpipTest”, “we”, “us”), an independent project operated by an individual based in Nova Scotia, Canada. They cover the website at celpiptest.org, our applications and any related services (collectively, the “Service”). Our Privacy Policy is incorporated into these Terms by reference.
CelpipTest is currently run as a sole operation, not a registered company. The legal name of the operator is available on written request to support@celpiptest.org. If you do not agree to these Terms, please do not use the Service.
Not affiliated with Paragon / CELPIP
CelpipTest is an independent study and practice platform. We are not affiliated with, endorsed by, sponsored by or otherwise associated with Paragon Testing Enterprises, the University of British Columbia, or the official CELPIP® programme. “CELPIP” and any related marks are the property of their respective owners and are used here only for descriptive purposes (nominative fair use). Only Paragon Testing Enterprises can administer the official CELPIP test and issue official scores.
Eligibility & accounts
- You must be at least 16 years old to use the Service.
- You must provide accurate registration information and keep it up to date.
- You are responsible for keeping your credentials confidential and for everything that happens under your account. Notify us immediately at support@celpiptest.org if you suspect unauthorised access.
- One account per person. You may not create accounts by automated means, transfer your account, or share access with others.
Licence to use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your personal, non-commercial study of the CELPIP test. All rights not expressly granted are reserved by us and our licensors.
Subscriptions, billing & renewals
Some features of the Service require a paid subscription (“Pro”). We currently offer Weekly, Monthly, Yearly and Lifetime plans. Prices, features and any taxes are shown at checkout (and where required, on the Upgrade page) and may change from time to time, but never for an existing billing period you have already paid for.
- Payment processor. All payments are processed by Stripe. By subscribing you also agree to Stripe’s end-user terms.
- Auto-renewal. Weekly, Monthly and Yearly plans renew automatically at the end of each billing period using the payment method on file, until you cancel.
- Lifetime plan.A one-time payment that grants access to the Service for as long as it is reasonably operated by us, subject to these Terms. “ Lifetime” refers to the lifetime of the Service, not your biological lifetime.
- Receipts. Stripe issues receipts for each successful payment to the email on your account.
- Failed payments. If a renewal payment fails, we may suspend Pro access until the issue is resolved. We will notify you and give you a reasonable opportunity to update your payment method.
Free trials and coupons
- We may offer free trials to first-time users. Unless we say otherwise at sign-up, a paid plan starts automatically at the end of the trial. You can cancel at any time during the trial to avoid being charged.
- Coupons are subject to their stated rules (eligibility, expiry, limit per user). They have no cash value, can’t be combined unless we explicitly allow it, and can be revoked if used in bad faith.
Cancellation & refunds
- You can cancel an auto-renewing plan at any time from
/account/billing. Cancellation takes effect at the end of the current billing period — you keep Pro access until then. - Default rule: all charges are final and non-refundable, to the maximum extent permitted by law.
- 14-day goodwill refund. As a courtesy, if you ask within 14 days of your first paid charge on a given plan and you have used fewer than 3 AI-scored Writing or Speaking submissions during that period, we will refund the most recent charge. Email support@celpiptest.org.
- Nothing in these Terms limits non-waivable consumer-protection rights you may have under the laws of your province (e.g. Quebec’s Consumer Protection Act, the Ontario Consumer Protection Act, BC’s Business Practices and Consumer Protection Act).
Your submissions (User Content)
The Service lets you create content — including written responses, audio recordings, feedback messages and notes (“User Content”). You retain ownership of your User Content.
You grant us a worldwide, royalty-free, non-exclusive licence to host, store, transmit, process, display and create derivative works of your User Content solely as necessary to:
- operate, maintain and provide the Service to you;
- send your submission to our AI scoring provider for feedback (see AI scoring);
- create de-identified, aggregated statistics that cannot reasonably be used to identify you;
- back up your data and comply with our legal obligations.
You represent that your User Content is yours, does not infringe anyone else’s rights, and does not contain anything unlawful, defamatory, hateful or harmful. We may remove User Content that violates these Terms or our Acceptable use rules.
AI scoring — what it is and isn’t
We use AI models (currently Google Gemini) to estimate scores and provide feedback on Writing and Speaking practice. By submitting a response you understand and agree that:
- AI-generated scores, CLB band estimates and rubric notes are study aids and estimates only. They are not, and do not predict, an official CELPIP result.
- AI output can contain errors, omissions or inconsistencies. You should not rely on it for any decision (immigration, employment, education) without independent professional advice.
- Your submission is sent to the AI provider as described in our Privacy Policy. Per our agreement with Google, submissions are not used to train Google’s models.
- We may change AI models, providers or scoring rubrics at any time to improve quality or for operational reasons.
Acceptable use
You agree not to:
- scrape, copy, mirror or republish the Service or its content;
- reverse engineer, decompile or attempt to extract the source code, data, prompts or rubric definitions of the Service or any AI integration;
- resell, sublicense or otherwise commercialise access to the Service (e.g. by using one account to score essays for paying third parties);
- submit content you don’t have rights to, or that is unlawful, infringing, threatening, harassing, hateful, sexually explicit, or that contains malware;
- interfere with the Service, probe it for vulnerabilities (other than via a coordinated security disclosure to support@celpiptest.org), or attempt to bypass rate limits, paywalls, anti-bot or authentication mechanisms;
- use the Service to generate content that you then pass off as your own work in any official CELPIP exam or other assessment in a way that violates the rules of that assessment.
Our intellectual property
The Service — including its design, layout, code, lessons, sample questions, vocabulary lists, scoring rubrics, prompts, brand and logos — is owned by us or our licensors and is protected by Canadian and international copyright, trademark and other laws. Except for the limited licence in section 4, nothing in these Terms transfers any ownership or rights to you.
If you believe content on the Service infringes your copyright, send a notice to support@celpiptest.orgwith: (a) your contact details; (b) identification of the copyrighted work; (c) the URL of the allegedly infringing content; and (d) a statement that the information is accurate and that you are the rights holder or authorised to act on their behalf. We respond to notices in a manner consistent with Canada’s “Notice and Notice” regime under the Copyright Act.
Third-party services
The Service relies on third-party providers (such as Stripe, Google Gemini, Resend, Cloudflare). The Service may also link to third-party websites. We are not responsible for third-party content or services, and your use of them is governed by their own terms and privacy policies.
Availability & changes
We work hard to keep the Service available and accurate, but we do not guarantee uninterrupted, error-free or completely secure operation. We may add, change, suspend or discontinue features, content or plans at any time, with or without notice — except that we will not retroactively reduce paid features for an active billing period you have already paid for.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OF AI OUTPUT, OR THAT USE OF THE SERVICE WILL RESULT IN ANY PARTICULAR CELPIP SCORE OR IMMIGRATION OUTCOME.
Some jurisdictions (including parts of Canada) do not allow the exclusion of certain implied warranties; in those cases, the above exclusions apply to the maximum extent permitted by law.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill or business interruption, even if advised of the possibility of such damages.
- Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, and (b) CAD $100.
Nothing in these Terms limits liability that cannot be limited by law (such as for gross negligence, fraud, or non-waivable consumer rights under your provincial law).
Your indemnity
You agree to indemnify and hold harmless CelpipTest and its officers, directors, employees and contractors from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of: (a) your User Content; (b) your use of the Service in violation of these Terms; or (c) your violation of any law or third-party right.
Termination
- You can stop using the Service at any time and delete your account from
/account. - We may suspend or terminate your access if you breach these Terms, if continued provision would expose us to legal risk, or for prolonged inactivity. We will give you reasonable notice unless doing so would worsen the breach.
- Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, Governing Law, and these Miscellaneous provisions) will continue to apply.
Governing law & disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable in that Province, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and we agree that the courts located in Halifax, Nova Scotia, Canada have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
Nothing here deprives you of mandatory rights granted by the consumer-protection laws of the province where you ordinarily reside.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top and — for significant changes — give you reasonable advance notice (in-app banner or email). If you keep using the Service after the effective date, you accept the updated Terms. If you don’t agree, please stop using the Service and, if you have an active subscription, you may request a pro-rated refund of the unused portion at our discretion.
Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms shown at checkout, are the entire agreement between you and us regarding the Service.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Severability. If a provision is held unenforceable, the rest remain in effect.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets.
- Notices. We may give you notices in-app or by email to the address on your account. You may give us notices at the contact below.
- Language. The English version of these Terms is the controlling version. Any translation is provided for convenience only. Quebec residents: les parties ont expressément exigé que ces Conditions, ainsi que tous les documents qui s’y rapportent, soient rédigés en anglais.
